Terms of Use

These terms govern your access to and use of Football Banter. By creating an account or using the service, you agree to these terms.

Eligibility and accounts

You must be at least 18 years old and legally able to enter into these terms.

When creating an account, you agree to provide accurate information, keep your sign-in methods secure and tell us promptly if you believe your account has been compromised.

You are responsible for activity carried out through your account. You must not create an account for someone else, impersonate another person or use another person's account without permission.

You may delete your account at any time using the account deletion options provided in the service.

Community conduct

Football Banter is built for supporters to share opinions, debate, compete and enjoy football together. Strong opinions, rivalry, humour and football banter are welcome. Abuse is not.

Football Banter has no tolerance for objectionable content or abusive users.

You must follow our Community Guidelines when using the service.

You must not:

• Harass, bully, threaten or intimidate other people.
• Encourage violence or other unlawful activity.
• Publish unlawful, defamatory or infringing material.
• Post hate speech or target people based on protected characteristics.
• Share another person's private or sensitive information without appropriate permission.
• Impersonate another person, club, organisation or public figure in a misleading way.
• Sexually exploit or endanger children.
• Post or distribute malware, scams or other malicious material.
• Manipulate engagement, rankings, points, predictions or competitions unfairly.
• Attempt to circumvent bans, suspensions or other safety controls.
• Scrape, copy or systematically collect information from the service without our permission.
• Attempt to gain unauthorised access to accounts, systems or data.
• Interfere with, disrupt or compromise the operation or security of Football Banter.

You can disagree with another supporter. You can challenge their football opinion. You can have rivalry and banter. But you must not use football banter as a reason to abuse or harm another person.

Reporting and moderation

If you see content or behaviour that you believe breaches these Terms or our Community Guidelines, you can report it using the reporting tools available within Football Banter or by contacting us through the contact details provided in the app.

We use human moderators, automated systems, or a combination of both to identify, review and respond to reports of objectionable content and behaviour.

We will review reports of objectionable content within 24 hours of receiving a report. Where a report identifies content that breaches these Terms or our Community Guidelines, we will remove the offending content and suspend or permanently terminate the account responsible for providing that content, as appropriate.

Depending on the circumstances, we may also:

• Remove or restrict additional content.
• Issue warnings where appropriate.
• Limit particular account features.
• Remove points, rankings or other benefits obtained through rule-breaking.
• Suspend an account.
• Permanently terminate an account.
• Take other steps reasonably necessary to protect users and the service.
• Report serious or potentially unlawful activity to relevant authorities where appropriate or required by law.

We may take action without prior notice where necessary to protect users, the service or our legal obligations.

Your content

You retain ownership of the content you submit to Football Banter.

By submitting content, you give Football Banter a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt for technical display, distribute and display that content as reasonably necessary to operate, maintain, improve and promote the service.

For example, this may allow us to display your post to other users, include it in feeds or matchday areas, resize or technically process an image, and make it available through features you choose to use.

This licence ends when the content is deleted, except where copies need to be retained for legitimate purposes such as safety, legal compliance, dispute resolution, fraud prevention or backups, or where the content has already been legitimately shared by others.

You remain responsible for the content you submit.

You confirm that you have the rights and permissions necessary to submit your content and that your content does not unlawfully infringe another person's rights.

Do not upload content simply because you found it online. If someone else owns the copyright or other rights in content, you must have the necessary permission or legal right to use it.

Football information and competitions

Scores, fixtures, news, lineups, statistics, fantasy football information and other football information may come from third-party providers. Information may occasionally be delayed, unavailable, incomplete or corrected.

Football Banter is not an official service of any football club, league, governing body, competition organiser, broadcaster or fantasy football provider unless expressly stated.

Football Banter may provide fantasy football features, including features relating to Fantasy Premier League, that allow users to create a fantasy team within Football Banter and, where supported and authorised, import or connect information relating to an existing fantasy team. Such features may rely on information, data or services provided by third parties and are subject to any applicable third-party terms, conditions and permissions.

Predictions, fantasy football features, Banter Points, leaderboards, rankings and fan battles are intended for entertainment and community participation.

They do not currently involve paid entry, cash prizes or gambling.

You should not rely on Football Banter content for betting, financial or other decisions where accuracy is critical.

We may change the rules, scoring systems or availability of fantasy features, predictions, competitions and other features as the service develops.

Our intellectual property

Football Banter's software, branding, interface, design, features and original content are protected by intellectual-property laws.

Except where we expressly allow it or applicable law permits it, these terms do not give you permission to copy, reproduce, sell, distribute, reverse engineer, modify or commercially exploit Football Banter or its intellectual property.

Football club, league, competition, player, publisher, data-provider and other third-party names, logos, images and assets belong to their respective owners.

Nothing in these terms gives you permission to use third-party intellectual property.

Third-party services

Football Banter may use or link to third-party services, including services for authentication, football data, news, hosting, storage, analytics, notifications and other functionality.

Third-party services may have their own terms and privacy policies, which apply to your use of those services.

We are not responsible for the content, policies, security or availability of third-party services.

Third-party news and external content

Football Banter provides a football news aggregation feature that allows users to discover news and articles from third-party publishers and websites.

News items displayed within Football Banter may include information such as article headlines, publisher names, publication dates, summaries or other information supplied through third-party feeds, APIs or other permitted sources.

Football Banter does not host or reproduce the full articles of third-party publishers within the Football Banter service. Where a news item relates to an article published by a third party, selecting that item may take you to the website, application or online service operated by the relevant publisher, where the full article or other content can be accessed.

The relevant third-party publisher remains responsible for the content of its article and website. Your use of content after following a link from Football Banter is subject to the terms, conditions, privacy policies and other policies of that third-party publisher.

Football Banter does not claim ownership of third-party articles, trademarks, logos, photographs, images, data or other intellectual property displayed or referenced through the service. Such rights remain with their respective owners or licensors.

Where third-party news or content is displayed, Football Banter aims to identify the relevant publisher or source and provide appropriate attribution and, where applicable, a link to the originating website.

Third-party news sources, feeds, APIs and external links may change or become unavailable from time to time. Football Banter does not guarantee the accuracy, completeness, availability or continued accessibility of third-party content.

Football Banter does not endorse, control or assume responsibility for third-party websites, publishers or services accessed through links provided within the Football Banter service.

Availability and changes

We aim to provide a reliable service, but Football Banter may occasionally be unavailable or experience errors, delays or interruptions.

We may maintain, update, modify, suspend or discontinue features or parts of the service.

We may also update these terms when we introduce new features, change how the service operates, need to reflect changes in law or need to clarify our rules.

Where we make material changes, we will provide reasonable notice where appropriate.

You can stop using Football Banter and delete your account at any time.

Disclaimers and liability

Football Banter is provided with reasonable care and skill, but we do not promise that the service will always be uninterrupted, error-free, secure or available.

Nothing in these terms excludes or limits rights or protections that cannot legally be excluded or limited, including applicable UK consumer rights, or our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

To the extent permitted by law, we are not responsible for losses that were not reasonably foreseeable when you accepted these terms, or for business losses arising from personal use of the service.

We are not responsible for opinions, predictions, commentary or other content posted by users. User-generated content represents the views of the person who posted it and does not necessarily represent the views of Football Banter.

Privacy

Our Privacy Policy explains how we collect, use, store and protect your personal information and the rights available to you.

Governing law

These terms are governed by the laws of England and Wales.

If you are a consumer, you may also benefit from mandatory protections under the laws that apply where you live and may have the right to bring proceedings in the courts available to you under those laws.
